Overview

This Policy has been written based on the decision n. 229 dated 8 May 2014, named “Simplified Arrangements to Provide Information and Obtain Consent Regarding Cookies” and on the decision n. 231 dated 10 June 2021, named “Guidelines on the use of cookies and other tracking tools”, both issued by the Italian Data Protection Authority. This Policy complements and updates other policies already published on this Site; when in combination with those policies, this Policy meets all the requirements of Article 13 of the Regulation (EU) 2016/679.

Important Statement
All third parties shall be aware that using this Policy, even partially, on other websites, where it would certainly be not relevant and/or improper and/or incongruous, may lead to strong penalties from the Italian Data Protection Authority.

What are Cookies?
In simple terms, cookies are tracking systems consisting of a small file stored from a website to your device. This file helps that website remember information about your visit and improving the website performance, thus enhancing your navigation experience.
Technically, cookies are defined as strings of text (generally composed of a combination of letters and numbers) used by websites (i.e. first parties) visited by users, or which different websites/web servers (i.e. third parties) locate and store, directly and/or indirectly, within a device (a computer, a tablet, a smartphone, etc.) available to the user. The servers either used to navigate the Internet or running on a device may store cookies to re-send them to the same websites which generated them, in view of a possible new visit by the same user. Specifically, these tracking tools allow websites to remember a certain device or browser.

Types of Cookies and their Purposes
The different types of cookies are given below.

  1. Technical cookies are used solely for the purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contracting party or user to provide that service” (see Section 122 (1) of the Code). Technical cookies do not require any consent by the user; however, they shall be properly stated in any cookie policy;
  2. Profiling cookies used to trace specific actions or recurring behavioural patterns in the use of the offered functionalities back to specific, identified or identifiable individuals; this is aimed to enable the controller to provide increasingly customised services beyond what is strictly necessary for the delivery of the given service and also send targeted advertising messages, i.e. messages that are in line with the preferences expressed by the user in the context of their web-browsing activities;
  3. Analytics cookies installed on the user device by the providers of the visited website or third-party websites. Third-party cookies are mainly analytic cookies deriving from Google Analytics 4 functionality when using a proxy server. In any case, cookies do not enable user identification and are related to each individual device or application in order to avoid tracing the user’s browsing data.

 Analytics cookies may be considered as technical cookies, i.e. they do not need the user’s consent, under the following circumstances:
– Their use is limited to aggregated statistical data relevant to the website visited by the user;
– With reference to third-party analytics cookies, when using Google Analytics 4, the collected data will not be transferred outside the EU without any assurance of appropriate data protection;
– With reference to third-party analytics cookies, the third party shall be prevented from using analytics cookies together with other processing technologies or transfer analytics cookies to other third parties.

Applicable Laws
As for the use of cookies and other technical identifiers, the controller shall be only required to provide specific information where appropriate as part of the general information notice. Conversely, cookies and other tracking tools serving purposes other than the technical ones may only be used after obtaining the user’s informed consent, which shall be explicitly expressed as stated in Recital 32.

Cookie Consent

The Data Controller ensures cookie consent by displaying a banner upon the user’s first access to the Site.

This banner includes:
– An X symbol in the upper right corner, meaning you have given no consent to cookies;
– A brief notice stating that technical cookies are used on the site, and that profiling cookies are used only if the user explicitly opts in;
– A command for your explicit consent;
– A link to a section where you can select and customise cookies by explicitly opting in to functionality, providers and specific cookies;

If you do not give your consent to cookies and other tracking systems, and if you choose to opt in to certain cookies only, this choice will be recorded and no longer solicited, except when:
– One or more policy terms have been significantly changed;
– The website manager cannot acknowledge if a cookie has been already stored to the device being used;
– At least 6 months have passed since the banner has been previously displayed.

Legal Basis of the Provision
For technical cookies, the legal basis of the provision is the legitimate interest of the data controller, in accordance with Art. 6, point f) of the GDPR, as technical cookies are required for the website to properly operate. For non-technical cookies, the legal basis of the provision is the user’s explicit consent, which may be withdrawn in accordance with Art. 6, point a) of the GDPR.

Rights of Data Subjects
